This Education Data Agreement ("Agreement") sets out the terms under which a teacher, school, or district ("School") allows ChoreScore ("we," "us," or "our") to process student information. It works together with the Education Privacy Policy, which is incorporated into this Agreement by reference. By creating a classroom and acknowledging these terms, the School agrees to this Agreement.
The parties to this Agreement are ChoreScore and the School (acting through the teacher who creates the classroom). The School is the controller of, and remains responsible for, the student records and any required parental notice or consent. ChoreScore acts as the School's service provider and school official, processing student information only on the School's behalf and under its direction to provide the service.
The teacher acknowledges this Agreement when creating a classroom. Each acknowledgement is recorded with a timestamp. Students (or those acting on their behalf) acknowledge the applicable terms when joining a class with the class join code, and that acknowledgement is also recorded with a timestamp. These records evidence acceptance of this Agreement and the Education Privacy Policy.
We use student data only for the limited educational purposes of providing and supporting the service: operating classrooms, assigning and tracking tasks and study packs, running classroom activities such as class tasks, classroom rewards, and learning games, awarding credits and points, maintaining streaks and class leaderboards, enabling teacher review of submissions, and providing optional AI coaching feedback when a teacher enables it. We do not sell student data, and we do not use it for advertising or to build a profile of a student for any purpose other than running the service for the School.
A student may attach a photo as proof that a class task was completed. Such a photo may only be attached after the School has recorded photo consent for that student. Task-proof photos are uploaded and used solely so the student's own teacher can review the work inside the classroom, and are stored only for as long as needed for that review.
Learning games, such as Eye Spy, may ask a student to take pictures on their own device as part of play. These game pictures stay on the student's device during the game — they are not uploaded to us, are not stored on our servers, and are not reviewed by the teacher. Only the game result (such as the letter played and how many items were found) is recorded.
No classroom activity photo — whether task proof or a game picture — is ever sent to any artificial intelligence or machine-learning system or used for advertising. Classroom tasks, rewards, and learning games do not use AI at any stage.
Student data remains the property of, and under the control of, the School (or the student or parent as provided by law). We claim no ownership of student data and will not use it for any purpose beyond running the service as directed by the School and described in the Education Privacy Policy.
An authorized teacher (or the student) may request an export of a student's stored data at any time, and we will provide it in a reasonable format. A student's data will be permanently deleted on request, removing the student's profile and associated activity records. We aim to complete verified export and deletion requests within thirty (30) days. Requests may be made in the app or by emailing hello@chorescore-app.com.
We store student data in a secured database, restrict access to authorized sessions, and store passwords only as salted, one-way hashes. We use reasonable administrative, technical, and physical safeguards to protect student data against unauthorized access, disclosure, or loss. While no system can be guaranteed perfectly secure, we will notify the School without undue delay if we become aware of a breach affecting its student data.
This Agreement remains in effect while the School uses ChoreScore for its classrooms. Either party may end it by closing the classrooms or by written notice. On termination, the School may export its student data, and we will delete the School's student data within a reasonable time after the export window unless retention is required by law.
Student data is stored and processed in the United States and potentially other countries whose data-protection laws may differ from those where the School is located. Where the General Data Protection Regulation (GDPR) or a similar law applies, we act as the School's processor, handle student data only on the School's documented instructions, assist with data-subject requests, and rely on appropriate transfer safeguards (such as Standard Contractual Clauses) where required. The School remains responsible for the lawful basis and any parental notice or consent required in its jurisdiction.
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to this Agreement, and ChoreScore's total aggregate liability arising out of or relating to this Agreement will not exceed the greater of the amounts (if any) paid to us for the educational service in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). Nothing in this Agreement limits liability that cannot be limited under applicable law, including our obligations regarding the protection and permitted use of student data. Each party is responsible for its own acts and omissions to the extent provided by law.
Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, war, civil unrest, government action, internet or utility failures, third-party service outages, or cyberattacks.
This Agreement is governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules, except where the mandatory law of the School's jurisdiction (including student-data-privacy law) requires otherwise, in which case that law controls to the extent required. This Agreement, together with the Education Privacy Policy and our Terms of Use, is the entire agreement between the parties about the educational service. If any provision is unenforceable, the rest remains in effect.
Questions about this Agreement, or requests to export or delete student data, can be sent to hello@chorescore-app.com.
